Biography

Professional career:

Gaël Hichri holds a PHD in Economic Law with his thesis devoted to “Pharmaceutical Distribution” (2007).

After several experiences in French and foreign law firms, Gaël Hichri began his career in September 2009, in the “Competition Law – Distribution – Pharmacy” department of Toison Villey Broud law firm.

Thereafter, he joined the “Antitrust – Competition Law” department of Orrick Law Firm, where he became a senior associate.

Gaël Hichri is specialized in competition and distribution law, and has significant experience in counselling and defending companies in matters of anti-competitive and restrictive practices.

Gaël Hichri works on a daily basis with his clients and supports them in particular in the organization of their distribution networks, their commercial and pricing policies, their suppliers and their competitors.

He also represents his clients in actions before the French Competition Authority,particularly in cases related to vertical cartel practices (prohibition of resale on the Internet & marketplaces, imposed resale prices, etc.) and abuse of dominant position.

He intervenes during disputes between suppliers and distributors. In particular, actions brought by the Minister of the Economy, before the Commercial Courts on the basis of article L.442-1 of the Commercial Code (sudden termination of established commercial relations, significant imbalance, unrequited advantages, etc.).

Gaël has considerable expertise in market access and distribution of health products (medicines, medical devices). He thus supports his clients, both in counselling and in litigation, in the development of their marketing authorization strategies.

He also assists his clients on pricing, reimbursement, promotion (advertising, DMOS regulations), and marketing strategies for health products.

Furthermore, Gaël has published numerous articles devoted to Competition and Distribution law, particularly in the pharmaceutical sector.

Finally, he gives courses on competition law and pharmaceutical regulation at the Master 2 “European Market and Regulation Law” (Paris University Paris II Panthéon-Assas).
