Legal500 EMEA 2011: Magenta recommended firm in Telecoms, internet & new technology (tier 3 ranking)

Internet is not an area of lawlessness.

Net neutrality, privacy protection issues in the context of the Web 2.0 development, cybersquatting, cybercrime, copyright protection and compensation of beneficiaries, such are the challenges faced by today’s internet users and operators.

Some of these issues call for specific solutions. Illustrating this, the Loi pour la Confiance dans l’Economie Numérique (Trust in Digital Economy Act) voted on 21 June 2004, has established a separate liability regime, on the one hand, for internet providers and on the other hand, for hosts.

However, the distinctive features of the Internet do not allow its operators to ignore general rules applicable to their business, as in the case of their communication or e-commerce activities: personal data protection, intellectual property rights, trademarks, etc.

Magenta is qualified to assist its clients on all of these issues relating to the Internet :

  • Management of the levels of liability for the main internet operators (internet providers, hosts, search engines). Assistance and representation before civil and criminal courts
  • Creation and edition of Internet websites (drafting of general conditions of use, privacy policy, personal data, acquisition of rights from various contributors…)
  • Advice on the issue of trademarks and domain name registration
  • Assistance with the setting-up of an e-commerce activity (Business to Business, Business to Consumer, online payments, conclusion of contracts, etc.)
  • Support and advice relating to the management of personal data (process notification, compliance with information rules, drafting and negotiation of outsourcing or data transfer contracts, compliance audit)

In the past few months, Magenta’s lawyers have had the opportunity to act on the following deals :

  • Litigation on behalf of an Internet provider against video-game beneficiaries
  • Assistance with the creation of an e-commerce website for a telecommunication operator
  • Litigation on behalf of an Internet provider involving the rules relating to Loi pour la Confiance dans l’Economie Numérique (Trust in Digital Economy Act): filtering obligations – liability of the provider/hosting company
