Sylvain Justier, who holds a DJCE-DESS in Business Law (post-graduate degree) from Rennes I University, started his career at CMS Bureau Francis Lefebvre in January 2001 in the Europe, Competition and Economic Regulations team, of which he became manager in 2006. In 2007, he joined the Antitrust and Regulatory practice of White & Case LLP.

Specialised in competition law, he has also developed a recognised expertise in telecommunication and new technologies law, sectors in which he frequently assists major internet and mobile telephone operators on all the issues they encounter: interconnection and access to fixed and mobile networks, allocation of frequency bands, operator cooperation, etc.

For instance, he assisted various operators wishing to become MVNO, by helping them in the negotiations with their host operators and by representing them in their dispute resolution proceedings. He also led various actions before the competition authorities, dealing with practices jeopardising the competitive development of the sector, as well as before the commercial courts, to obtain damages for the prejudice suffered by his clients (private enforcement action, one of which led to the highest indemnity sentence ever held to this day in the new technologies sector - € 15 million).

Sylvain Justier also frequently acts in the energy sector (assistance with the development of wind energy or photovoltaic projects, drafting and negotiation of gas and electricity purchase agreement, access to network issues, etc.) and in the media sector (including access to data/contents).

Sylvain Justier is also experienced in distribution law (commercial policies, franchise networks, commission-based affiliation, commercial agency agreements) and in consumer law, area in which he has addressed the court in more than 10 comparative advertising cases.
Sylvain Justier frequently takes part in major conferences dedicated to these sectors and is the author of many articles.

Vincent Jaunet

Vincent Jaunet, who graduated from ESSEC (E98) and holds a DJCE - DESS in Business Law (post-graduate degree) at Paris II Assas University, was part of the Europe, Competition and Economic Regulations team at CMS Bureau Francis Lefebvre from 2003 until 2007. In 2007, he joined the Antitrust & Regulatory practice of White & Case LLP.

SpSpecialised in competition law (collusion, abuse of dominance, State aids, merger control, restrictive practices and unfair competition), he has also developed his expertise in energy law, an area in which he frequently assists major operators such as suppliers, producers, traders or intensive industrial electricity users on all the issues they encounter: access to network, drafting and negotiation of gas and electricity purchase agreements, project development in the renewable energies sector (wind energy, photovoltaic, biomass), administrative procedure before national and Community authorities, relations with the regulator, etc.

Thus he helped a major industrial client in its negotiation towards the creation of an electricity purchasing consortium on the basis of long-term contracts as well as with the setting up of different partnerships with energy producers. He also assisted different clients, producers and consumers, in their steps to obtain a network connection for their production sites or important industrial consumption sites. He also led various assignments in relation to the exchange of greenhouse gas quotas.

Vincent Jaunet also frequently acts in the telecommunication sector (drafting and negotiation of interconnection contracts, provision of data for the universal phone book, rare resources allocation – numbers or frequency bands, purchase of telecommunication services, etc.)

Vincent Jaunet is also experienced in consumer law (distance selling, e-commerce, door-to-door sales, cross-merchandising, comparative advertising, etc.), and in areas related to the process of personal data.

Vincent Jaunet also regularly takes part in conferences dedicated to telecommunication, energy or competition law and is the author of many articles.

Édouard Sarrazin

Édouard Sarrazin (DEA in European Law - Université Paris II, and LL.M in European Competition Law – University of London (Queen Mary and Westfield College) spent six years at the heart of Linklaters Paris Competition/Antitrust department prior to joining Magenta in 2010 as Counsel.

Specialized in both French and European competition law, he possesses a wealth of experience, with particular knowledge of contentious competition matters, most notably in the context of cartels. His expertise in this area encompasses related practical issues such as optimizing the use of economists and lobbyists, as well as those raised by the frequently multi-jurisdictional nature of such cases (class actions, the use of blocking statutes, and the criminal responsibility of directors and employees). Notably, he advised a major player in the air transport sector on an international cartel inquiry in the air freight sector conducted by a number of antitrust authorities worldwide (including the US department of Justice and the European Commission). His practice also comprises advising on unilateral practices and anti-competitive agreements.

Equally, he has significant experience advising industrial and private equity clients on merger control matters in a broad range of sectors, in particular transport. His expertise encompasses all aspects of procedure (due diligence, assessment of merger notification obligations, contractual analysis and competition assessment), the preparation and submission of notifications under French and EU law, the coordination of local lawyers when multi-jurisdictional notifications are required, and representing third-parties wishing to contest the approval of a transaction.

Noémie Kerbrat

Noémie Kerbrat graduated from Rennes I University with a DJCE – DESS in Business Law. After various internships with L'Oréal's legal team, with the Europe, Competition and Economic Regulations team of CMS Bureau Francis Lefebvre, and with the Antitrust and Regulatory practice of White & Case LLP, Noémie started her career as a lawyer in 2008 in the Competition department of law firm Darrois Villey Maillot Brochier. She joined Magenta in March 2009.

Specialised in competition law (antitrust, merger control, restrictive practices and unfair competition), she has been involved particularly in cases relating to the new technologies and media industries.

More specifically, she took part in the representation of a telecommunication operator in several litigation proceedings relating to the conditions of deployment of optical local loops and the challenge of exclusive broadcasting rights owned by one of its competitors. She also assisted several media operators in relation to the editing and distribution of audiovisual programmes.

Noémie also acts on a regular basis on cases relating to distribution and consumer law.

Guillaume Binoche

Guillaume Binoche graduated from Sciences Po Paris and holds a Master's degree in Euro pean Economic Law from Robert Schuman University. He spent three years at the heart of Gide Loyrette Nouel Competition /Antitrust department in Paris prior to joining Magenta in 2011.

Specialized in both French and European competition law, he possesses experience, with particular knowledge of contentious competition matters, most notably in the context of cartels and abuses of dominan t position.

Notably, he advised a major player in the railway transport sector in a national compe tition case in the railway freight sector. He also intervened in several cartel procedures in France in the banking se ctor.

Equally, he has experience advising industrial and private equity clients on merger co ntrol matters in a broad range of sectors, in particular transport, real estate and agribusiness.

Guillaume Binoche finally assists clients in commercial litigation proceedings and in contracts negotiation.

Aliénor Bouvier

Aliénor Bouvier graduated from Sciences-Po Paris and HEC Paris business school and holds a Master in public law from Paris I Panthéon-Sorbonne University. Aliénor did several internships with the Public and Regulatory law team of Allen & Overy LLP, the Antitrust department of Weil, Gotshal & Manges and the Litigation section of the French Council of State. Aliénor joined Magenta as an associate in September 2010.

Specialising in public law and competition law, Aliénor has dealt more specifically with cases related to the sectors newly opened to competition (telecoms and energy) and to the pharmaceutical sector.

In particular, she took part in the representation of a telecommunications operator in an antitrust litigation case before the French competition authority and participated in the development of various energy plant projects (nuclear energy and renewable energies), focusing on competition law, public law and energy law aspects.

She also assisted a pharmaceutical company on regulatory and commercial policy issues.

In addition, Aliénor intervenes in cases related to restrictive practices and distribution law.

Amélie Le Provost

Amélie Le Provost graduated from Sciences-Po Paris and holds a Master's degree in Public Economic Law from Paris II Panthéon-Assas University. She began its career in 2010 with Weil, Gotshal & Manges in the Public Law and Regulated Sectors Department prior to joining Magenta in October 2011.

Specializing in public law, Amélie frequently assists firms operating in the energy, electronic communications and health fields within the framework of their regulatory issues, including matters related to competition stakes.

Amélie took part in the representation of a telecommunications operator before the French competition authority and the administrative courts in disputes relating to the fixing of differential mobile termination rates or to the award of the fourth 3G mobile license. She also assisted several energy operators confronted with changes in the regulatory framework applying to sustainable energy sources (solar and wind power in particular) or to CO2 quotas policy.

She also intervenes on matters relating to publicly-owned entities (statutory changes, public contracts) and assisted a leading firm in the European concessions and public works sector, for instance, within the negotiation of a public-private partnership concerning a high-speed railway.

Ania Yahiaoui

Ania Yahiaoui, who holds a Master 2 in business law – DJCE from Rennes I University, joined Magenta as an associate in 2011 after several internships with the L’Oreal’s legal team and the Contracts – Business law Department of CMS Bureau Francis Lefebvre.

Ania is regularly involved in cases related to competition law (antitrust and merger control) and distribution law, for instance regarding the organization of distribution networks, the negotiation of distribution agreements and litigation proceedings regarding restrictive practices.

She has thus notably assisted a pharmaceutical company for the rewriting of its distribution agreements and the negotiation of its industrial agreements.

Finally, Ania also intervenes in commercial litigation proceedings and in consumer law cases.
